PROCEDURAL POSTURE Plaintiff seaman appealed a decision of the United States District Court for the Southern District of Mississippi, which denied the seaman's motion brought under Fed. R. Civ. OUTCOME: The court vacated the district court's denial of the seaman's motion and remanded for an evidentiary hearing.
